A money claim in England and Wales, cheapest step first

This is the path a small money claim takes. Criminal, IP, commercial and judicial-review matters follow their own routes — and a judicial review has to be brought within three months.

  1. Letter before claim

    The pre-action protocols expect you to set out the claim and give the other side a chance to respond before issuing. Skipping it can cost you on costs later.

    A money claim can be issued online. The court fee scales with the amount claimed, and the fixed costs of issuing are among the few things you can recover.

  3. Allocation to a track

    Not more than GBP 10,000 is normally the small claims track; to GBP 25,000 the fast track; above that the multi-track. The track decides how the case is run and what costs follow.

  4. The hearing — informal, and on your own account

    The strict rules of evidence do not apply, evidence need not be on oath, and the judge may limit cross-examination (CPR 27.8). You may be represented, but solicitor and counsel fees are not recoverable (CPR 27.14).
