This is the path a small money claim takes. Criminal, IP, commercial and judicial-review matters follow their own routes to the courts above. The Tribunal is fast and cheap, but it will not find your defendant, gather your evidence or advise you.

  1. Letter of demand

    State the debt, the basis and a deadline. It costs postage, and it is the first document you will hand up if the other side ignores it.

    The Tribunal cannot give legal advice and says so. It points enquirers instead to the Duty Lawyer Service free legal advice scheme — worth using while you can still choose whether to file.

  3. File in person at the Registry

    Forms 1 and 2, in person during office hours — not by post, fax or email. You must supply the defendant’s Hong Kong address; the Tribunal will not trace them for you. The first hearing follows within 60 days.

  4. Call-over, then the hearing

    At the call-over the Adjudicator will try to mediate, explaining the law and the pros and cons of pressing on. If it does not settle, you argue it yourself — and you may ask for your lost wages for attending.
